In early 2025, just one week after filing his second federal request, he uncovered what he alleges to be systemic metadata surveillance of Access to Information and Privacy Act requesters by Canadian institutions.

Those surveillance findings are now the subject of live litigation before the Federal Court of Canada, with Duska appearing as the lead complainant and pro se applicant in multiple cases concerning due process, metadata targeting, and institutional accountability.
